– Intellectual Property

Your brand is an asset so why are you not protecting it? Did you know that if you do not own a federal trademark for your brand, you cannot bring a trademark infringement suit if someone else is using your logo or brand name? Crazy, right?

Trademarks

So what is a trademark anyway? A trademark acts a source identifier for your brand or your business. It is what people use to differentiate your goods and/or services from other brand’s goods and/or services. Trademarks are eligible to be registered on the state and federal level – and both can give you unique benefits. For example, in the State of Michigan, because marijuana is legal, you are permitted to register state trademarks for marijuana products, but because marijuana is still illegal on the federal level, you cannot register marijuana products on the federal level; but you can register other things such as packaging, apparel, or merchandise on the federal level for your brand.

So why else are trademarks important? Trademarks have the ability to last indefinitely as long as they are maintained. Trademarks can also be sold, licensed, or even assigned.
